These Terms and Conditions (“Terms”) constitute a legally binding agreement between Stethzcope Technologies Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at 12/68/A, Ward No. 12, Mathanathkuzhi House, Kuniyil, Kizhuparambu PO, Malappuram (“Stethzcope,” “we,” “us,” or “our”), and you (“you,” “Doctor,” or “User”) in relation to your access to and use of the Stethzcope Doctor mobile and web application (the “Platform”). By registering for or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

1. Eligibility and Registration

1.1 Eligibility:

Use of the Platform is restricted to licensed and registered medical professionals legally permitted to practice medicine under applicable laws. You must be at least 18 years of age to access the Platform.

1.2 Account Registration:

To access the services, you must create an account by providing complete and accurate information, including but not limited to:

• Full name
• Contact details (email, mobile number, address)
• Gender and date of birth
• Medical registration/license number
• Qualifications and certifications
• Languages spoken
• Signature (for e-prescriptions)

You are solely responsible for the accuracy of the information provided and for maintaining the confidentiality of your login credentials.

1.3 KYC and Verification:

You agree to undergo identity and professional verification, including Know Your Customer (KYC) procedures. Stethzcope reserves the right to suspend or reject access if verification fails or is incomplete.

2. Professional Conduct and Responsibilities

2.1 You shall provide medical services in compliance with all applicable laws, professional standards, and ethical guidelines. You agree to:

• Act with professional diligence, care, and competence
• medical advice and services strictly within your area of certification
• Refrain from issuing misleading, unlawful, or unethical medical advice or prescriptions
• Not misrepresent your qualifications or impersonate another practitioner

2.2 You are solely responsible for any consultation, advice, or treatment provided via the Platform, and Stethzcope disclaims any liability for the same.

3. Hospital and Clinic Affiliations

3.1 Hospitals or clinics using the Stethzcope Hospital platform may invite you to join their network. Such requests will be sent to your registered email, and the affiliation will be activated only upon your explicit verification and consent.

3.2 You may be affiliated with multiple hospitals or clinics. Each institution may manage your:

• Consultation schedule and slot duration
• Modes of consultation (in-person, audio, video, or chat)
• Consultation fee structure

Any changes made by hospitals to your schedule or fees shall be visible to you and may be reviewed at any time.

4. Appointments and Consultations

4.1 You are responsible for setting and maintaining your availability, consultation slots, and fee structures via the Platform or through affiliated institutions.

4.2 You agree to honor all confirmed appointments. Repeated cancellations or no-shows without valid reasons may lead to account limitations or suspension.

4.3 You must exercise professional judgment during consultations and refer patients for in-person care when necessary.

5. Telemedicine and E-Prescriptions

5.1 Telemedicine:

The Platform enables teleconsultations through secure, encrypted channels. You agree to conduct remote consultations in accordance with applicable telemedicine guidelines and ensure patient confidentiality.

5.2 E-Prescriptions:

You may issue e-prescriptions via the Platform using your Electronic Signature. You confirm that:

• All prescriptions issued are accurate, lawful, and medically justified
• You are solely responsible for their content and impact
• E-prescriptions are compliant with governing regulations in your jurisdiction

6. Data Privacy and Confidentiality

6.1 Your use of the Platform is subject to our Privacy Policy (https://doctor.stethzcope.com/privacy-policy), which governs the collection, use, and protection of personal and professional data.

6.2 consent to:

• Display of your professional profile to patients and affiliated hospitals
• Secure storage and use of your Electronic Signature for e-prescriptions
• Sharing of limited data with trusted third-party service providers

6.3 You are expected to uphold patient privacy and confidentiality at all times in accordance with applicable law.

7. Intellectual Property

All intellectual property rights in the Platform, including text, software, UI/UX, and trademarks, are the exclusive property of Stethzcope or its licensors. You may not:

• Modify, reverse-engineer, copy, distribute, or create derivative works from the Platform
• Use our name, logo, or branding without prior written consent

8. Limitations of Liability

8.1 Stethzcope provides the Platform solely as a technology service. We do not provide medical advice, endorse any medical opinions, or guarantee the outcomes of any consultation.

8.2 We are not liable for:

• Clinical errors, malpractice, or negligence by you
• Disputes between you and patients or hospitals
• Technical issues, data loss, or system outages
• Any indirect or consequential damages

You are solely responsible for the accuracy, legality, and outcomes of all interactions through the Platform.

9. Termination and Suspension

9.1 We reserve the right to suspend or terminate your access to the Platform, without prior notice, for reasons including but not limited to:

• Breach of these Terms
• Misrepresentation or falsification of credentials
• Regulatory non-compliance
• Professional misconduct

9.2 Upon termination, you will lose access to all Platform features and data, subject to our data retention obligations under applicable law.

10. Amendments to Terms

We may revise these Terms from time to time. Your continued use after such updates constitutes acceptance of the modified Terms. It is your responsibility to review them periodically.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms, including disputes related to the use of the Platform, shall be subject to the exclusive jurisdiction of the courts located in Malappuram, Kerala.
